Terms of Use

These Terms of Use ("Terms") govern your access to and use of the FormAI mobile application and any related services (collectively, the "Service") provided by Emre Doğan, an individual developer operating FormAI ("we", "us", "our"). Contact: support@formai.app. By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Plain-language summary. FormAI is an AI-assisted fitness coach. You are responsible for exercising safely. Subscriptions auto-renew unless you cancel through your app store. We are not a medical provider, and FormAI is not a substitute for professional medical advice.

1. Eligibility & User Accounts

1.1 Age requirement

You must be at least 18 years old to create a FormAI account. The App verifies this with an age gate during onboarding; by creating an account you confirm that you are 18 or older.

1.2 Account registration

You may sign in using Google Sign-In, Apple Sign-In, or an email-based identity provider supported by the Service. You agree to provide accurate information, keep your sign-in credentials confidential, and notify us promptly of any unauthorized access.

1.3 One account per person

Accounts are personal and non-transferable. You may not share, sell, or sublicense your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used to abuse the Service.

1.4 Account deletion

You may delete your account at any time from Settings → Account → Delete Account. Deletion is permanent and removes your profile, workout history, body metrics, and feedback. Aggregated, non-identifying analytics may persist for product-improvement purposes.

2. Subscriptions & Auto-Renewal (RevenueCat)

2.1 FormAI Pro

Certain features of the Service ("FormAI Pro") are made available through paid subscription plans, including monthly, quarterly, and annual options. Pricing for each plan is displayed in the in-app paywall and is denominated in your local currency as supported by the relevant app store.

2.2 Billing through app stores

Purchases are processed by Apple App Store (in-app purchase) or Google Play Billing, and are managed on our side via RevenueCat, our subscription infrastructure provider. Your payment, billing, and refund relationship is with the relevant app store, in accordance with their terms.

2.3 Automatic renewal

All subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time:

iOS: Settings → [your name] → Subscriptions → FormAI.
Android: Google Play app → Profile → Payments & subscriptions → Subscriptions → FormAI.

2.4 Free trials

Where offered, free trials convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial ends. Cancelling during the trial prevents conversion to a paid plan.

2.5 Refunds

Refund eligibility is determined by Apple or Google according to their published policies. We do not directly process refunds for subscriptions; please contact the relevant app store. Where required by applicable law (including EU consumer-protection rules), statutory refund rights apply.

2.6 Price changes

We may change subscription prices. Material price changes will be communicated in advance through the app and/or by email, and you may decline by cancelling before the change takes effect.

3. Medical Disclaimer

FormAI is not a medical device, healthcare provider, or substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified physician before starting any exercise program, especially if you have a pre-existing condition, are pregnant, are recovering from injury, or take prescription medication.

3.1 No medical relationship

The Service provides general fitness, nutrition, and wellness information generated by AI models and content libraries. It does not establish a doctor-patient, dietitian-client, or therapist-client relationship. Information delivered through FormAI is for educational and informational purposes only.

3.2 Assumption of risk

Physical exercise carries inherent risk of injury, including but not limited to muscle strain, joint injury, cardiovascular events, and falls. By using FormAI you acknowledge and accept these risks, and you agree that you are solely responsible for evaluating whether any exercise, intensity, or program is appropriate for your fitness level and health condition.

3.3 Stop and seek help

If at any time during exercise you experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptom, stop immediately and seek qualified medical attention.

3.4 AI-generated content

Workout plans, nutrition suggestions, and pose-detection feedback are generated in part by machine-learning models. These outputs may be inaccurate, incomplete, or outdated. Apply your own judgment and consult a qualified professional before acting on them.

4. Acceptable Use

You agree not to:

Use the Service in any unlawful manner, or for any unlawful purpose;
Reverse-engineer, decompile, or attempt to extract source code, model weights, or other proprietary components;
Resell, lease, or sublicense the Service or any portion thereof;
Use automated systems (bots, scrapers) to access the Service except as expressly permitted;
Upload or transmit content that is unlawful, defamatory, harassing, infringing, or otherwise objectionable;
Interfere with the operation of the Service, attempt to gain unauthorized access to any account or system, or transmit malicious code.

5. User Content

You may submit information to the Service such as body metrics (weight, height, goals), workout feedback, and optional photos for progress tracking ("User Content"). You retain ownership of your User Content. By submitting it, you grant us a limited, worldwide, royalty-free license to host, store, and process it solely to operate, maintain, and improve the Service for you.

You are responsible for ensuring that you have the rights to submit any User Content and that it does not infringe on the rights of any third party.

6. Intellectual Property

The Service, including its software, design, AI models, copy, and brand assets, is owned by us and our licensors and is protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

"FormAI" and the FormAI logo are our trademarks. You may not use them without our prior written permission.

7. Third-Party Services

The Service relies on third-party providers including but not limited to: Apple App Store and Google Play (distribution and billing), RevenueCat (subscription management), Supabase (cloud database and authentication), PostHog (anonymous product analytics), Sentry (crash and error reporting), Google ML Kit (on-device pose detection). Their respective terms govern your use of those services. See the Privacy Policy for processing details.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT THAT ANY FITNESS, NUTRITION, OR HEALTH OUTCOME WILL BE ACHIEVED THROUGH USE OF THE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE, INCLUDING ANY PHYSICAL INJURY SUSTAINED DURING OR AFTER PERFORMING EXERCISES SUGGESTED BY THE SERVICE.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY EUROS (€50).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the smallest extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence where applicable).

10. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, and our personnel from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service in breach of these Terms, (b) your User Content, or (c) your violation of any law or third-party right.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access — temporarily or permanently — if you breach these Terms, if continued provision of the Service to you is no longer commercially reasonable, or if required by law. Sections that by their nature should survive termination (including Sections 5–9 and 12–14) will survive.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service and, where appropriate, by email or in-app notification at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles. The Istanbul Central (Çağlayan) Courts and Enforcement Offices shall have exclusive jurisdiction for any dispute arising out of or related to these Terms, except where mandatory consumer-protection laws of your country of residence provide otherwise.
